Searching
Once a new name (or several possible names) has been selected, it is critical to submit the name for a clearance search. Without performing a clearance search, it is impossible to know whether another company is already using the same name or a confusingly similar one in the marketplace. A clearance search will also determine whether the proposed name(s) are available for registration. During the clearance search, it is also wise to determine whether related domain names are available for registration or are already in use by competitors.

Monitoring
As a valuable asset, a trademark must be protected and maintained. A trademark's strength and protection may be diminished unless action is taken quickly against infringing parties. It is especially important to monitor possible infringing variations of your trademark in the Official Gazette of the U.S Patent and Trademark Office, a publication which lists all the newly approved applications for trademark registration. If the trademark application of a third party may cause confusion among your customers it is important to file a timely Opposition with the Trademark Trial and Appeal Board within 30 days of the publication.

Early detection of potential trademark infringement is critical, because the failure to properly use your trademark or defend it against trademark infringers could diminish the protection and even cause result in abandonment or cancellation of the registration.
